I Frances Kirkman of Chesterfield in the County of Derby, widow, being of sound and perfect mind and memory, do make and publish this my last will and testament in manner and form following; that is to say: First I will that all my just debts and funeral expenses be fully paid and satisfied by my executrix hereinafter named, as soon after my decease as conveniently may be. And after payment of the same, I give and bequeath unto Thomas Hadley Senior of Rotherham in the County of York the sum of five pounds five shillings. Also I give and bequeath unto Elizabeth Swift of Chesterfield aforesaid, spinster, my faithful servant, the sum of five pounds five shillings. And all the rest, residue and remainder of my estate and effects whether real or personal, of what kind or nature soever or wheresoever, I give, devise and bequeath the same unto my daughter-in-law1 Mary Sowter of Chesterfield aforesaid and her heirs forever; excepting that if the said Mary Sowter shall die not having been married, in that case I do hereby give and bequeath unto Edward Fisher of South Carolina, son to my sister Mary Fisher, if (he) shall survive the said Mary Sowter, or otherwise unto his lawful issue if they or any one or more of them shall survive the said Mary Sowter, to be divided amongst them (if more than one) share and share alike, the sum of five hundred pounds out of the said residue and remainder of my estate and effects bequeathed as above to the said Mary Sowter, to be paid after her decease. And whereas it is my earnest desire that the said Mary Sowter my daughter-in-law may quietly and peaceably enjoy the above-mentioned bequest, I will that if the aforesaid Edward Fisher or any of his heirs shall disturb or cause to be disturbed the said Mary Sowter in the enjoyment of the same, the above conditional legacy of five hundred pounds to Edward Fisher or his issue shall be absolutely null and void, anything aforesaid to the contrary notwithstanding. And I do hereby appoint the said Mary Sowter sole executrix of this my last will and testament, hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal the tenth day of August in the fifth year of the reign of our sovereign Lord George the Third, by the grace of God of Great Britain, France and Ireland King, Defender of the Faith and so forth, and in the year of our Lord one thousand seven hundred and sixty-five. This will was proved at London the fourth day of September in the year of our Lord one thousand seven hundred and seventy-two before the Right Worshipful George Hay, Doctor of Laws, Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted, by the oath of Mary Sowter, spinster, the sole executrix named in the said will, to whom administration was granted of all and singular the goods, chattels and credits of the deceased, she having been first sworn by commission duly to administer. Notes: (1) As the probate confirms that Mary Sowter was a spinster, this has to be in the old sense of step-daughter. And as Frances Kirkman died a widow, this suggests that she was previously married to a Mr. Sowter and that Mary was his daughter by an earlier marriage. Lo and behold!
